1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of www.hypervuer.com and all related services (collectively, the "Service"), operated by Lared Media LLC, a Delaware limited liability company, and Elytra Studios, a company organized under the laws of Pakistan, operating jointly as "HyperVuer," "we," "us," or "our."

By creating an account or otherwise accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement and, if you are under the age of majority in your jurisdiction, that you have parental or guardian consent.

3. Accounts

  • Registration: You must create an account to access certain features of the Service. You agree to provide accurate, current, and complete information during registration and to keep it updated.
  • Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@hypervuer.com of any unauthorized use.
  • One Account per Person: Accounts are personal to you and may not be sold, transferred, or shared, unless we offer a family/multi-user plan.

4. The Service

HyperVuer provides a free video and media streaming platform allowing registered users to browse, watch, and interact with content made available on the Service. HyperVuer does not currently support user-uploaded content; all content is provided or licensed by HyperVuer.

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice, and without liability to you.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms;
  • Attempt to gain unauthorized access to the Service, other accounts, or related systems;
  • Use automated means (bots, scrapers, crawlers) to access the Service without our prior written consent;
  • Circumvent, disable, or interfere with security-related features of the Service, including digital rights management (DRM) or content protection measures;
  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission;
  • Reverse engineer, decompile, or disassemble any portion of the Service;
  • Interfere with or disrupt the integrity or performance of the Service;
  • Impersonate any person or entity or misrepresent your affiliation.

We reserve the right to suspend or terminate accounts that violate these Terms.

6. Intellectual Property

6.1 Our Content

All content available through the Service, including videos, graphics, logos, trademarks, software, and other materials (excluding third-party licensed content, which remains the property of its respective owners), is owned by or licensed to HyperVuer and is protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and stream content through the Service for your personal, non-commercial use only.

6.3 Restrictions

You may not download, copy, distribute, publicly perform, or create derivative works from content on the Service except as expressly permitted by the Service's functionality (e.g., an official download feature, if offered) or by applicable law.

7. Third-Party Content and Links

The Service may include content licensed from third parties or links to third-party websites. We do not endorse and are not responsible for third-party content, products, or services.

8. Termination

You may stop using the Service and delete your account at any time through your account settings or by contacting us.

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use the Service will immediately cease.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF ANY CONTENT AVAILABLE ON THE SERVICE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HYPERVUER, LARED MEDIA LLC, ELYTRA STUDIOS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100), AS THE SERVICE IS PROVIDED FREE OF CHARGE.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless HyperVuer, Lared Media LLC, Elytra Studios, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms or your misuse of the Service.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of laws principles, except where prohibited by applicable local law.

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, United States, unless applicable law in your jurisdiction requires otherwise.

13. Changes to the Service and Terms

We may revise these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HyperVuer regarding the Service and supersede any prior agreements.
